The Bob Diamond Real Estate Program is conducted via written materials, CD’s, DVD’s, telephone conference call with simultaneous web-based presentations. We recommend committing between 5 to 10 hours per week to learning this system at a minimum. Your learning pace is controlled by your own skills and focus.

ADDITIONAL TERMS AND CONDITIONS

By purchasing the Services identified above, and by accessing any other product(s) and/or service(s) made available to you by on of our entities, Bob Diamond; Diamond Law Center, LLC;  Real Wealth Systems, Inc. (such as access to a Website, newsletters, on-going customer support and resource functions, etc.) you agree to be bound the terms and conditions set forth above, as well as those to follow. Additionally, access to and use of certain specific services (such as the Website, Newsletters, etc.) are also governed by the terms of this Agreement as well as separate terms of use some of which are set forth in this Agreement, and all of which are incorporated into this Agreement as if they were fully set forth herein. These separate terms of use may be accessed at www.diamondlawcenter.com/terms.asp or at the bottom of each web-page via the terms of use link.

Payment. Subject to your payment as outlined above, you have engaged Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and/or Bob Diamond to provide the described Services, and Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and/or Bob Diamond have agreed to provide such Services. Neither Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies nor Bob Diamond will be under any obligation to provide or continue providing any such Services if you should fail to pay for such Services or should you deviate from any agreed upon payment terms. Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and Bob Diamond reserve the right to terminate or suspend Services for non-payment or for default in payment terms.

 

Terms and conditions of refund

We will cheerfully refund your payment under the terms and conditions of this agreement. If you have requested a return and refund for this product, thus you are not going to use any part or portion of this product, have not installed or downloaded any of the forms, software or recorded the written computerized or webinars. Further, all products are being returned undamaged, without notes written in them and in re-sale-able condition after re-shrink wrapping. All bonus items must be returned unopened and unused.

Under the laws protecting intellectual property you are forbidden from using any of the knowledge, forms, marketing techniques and materials that you are returning in your business and from disclosing any information about our operations and these materials to others. If you have downloaded anything to your computer systems or made copies you cannot return the course. If we find that you have taken and copied the course that violates this agreement and we will pursue legal action for damages, the court with jurisdiction will be Philadelphia, Pennsylvania.

Many of our systems have tracking tokens installed on the discs and in the software as well as copy protection on the materials. The tracking tokens enable us to see if the software is installed on computers and in use and in cases automatically notify us of unauthorized use. If we find that these have been tripped we will not refund the materials but will return the course to you. If the tokens notify us that the software is being used by an unauthorized user we will investigate and press forward with either Civil or Criminal charges for theft of intellectual property.

All returns will be charged a 10% restocking fee, this is calculated by taking 10% of the selling price of the course.

CANCELLATION PERIOD
We are pleased to offer a conditional seven day right to cancel from receipt of the physical course. You do have the right to cancel your purchase up to midnight of the 7th day after receipt of the program if you have complied with all terms in this agreement. If you choose to cancel, you must email a cancellation request including a copy of your receipt to support@bobdiamond.com before midnight on the 7th day after your materials were delivered. Once the seven day cancellation period has ended, all sales are considered final and no refunds will be allowed for any reason. Our entire refund/cancellation policy, including specific instructions on how to exercise any applicable right to rescind, are set forth in our Terms of Use found at www.diamondlawcenter.com/terms

Signature or Electronic Confirmation. This Agreement must be acknowledged and accepted by either: 1) signing and returning the original hereof as set forth above, or 2) clicking the signature button below. Via your signature or the act of clicking the “Accept” button, you agree to all of the terms and conditions hereof, including those incorporated by reference. If you click the “Accept” button, you further consent to delivery of this Agreement in electronic form.

Duties of Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and Bob Diamond. You acknowledge that certain Services are provided and fulfilled by Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies whereas other Services are provided and fulfilled by Bob Diamond. Accordingly, you specifically agree to hold the non-providing party harmless from liability or damages associated with a particular Service provided by the other party.

Ownership; Rights; Proprietary Information; Publicity. Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and/or Bob Diamond shall own all right, title and interest (including patent rights, copyrights, trade secret rights, trademark rights and all other rights throughout the world) relating to any and all works of authorship, designs, know-how, ideas, course materials, and information made or conceived or reduced to practice, in whole or in part, by Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and/or Bob Diamond in connection with the contemplated Services or any “Proprietary Information” (as that term is used and defined below).
You agree that all course and coaching materials provided by Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and/or Bob Diamond as part of the Services constitute the “Proprietary Information” of either Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies or Bob Diamond or both. Accordingly, you agree to hold in confidence and no disclose or copy any Proprietary Information, except with the prior written consent of Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and Bob Diamond.

Indemnification, Defense and Hold Harmless. You understand that Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and Bob Diamond are in the business of, among other things, coaching and mentoring in the area of real estate. Neither Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies nor Bob Diamond provides any financial advice, personal consulting or guarantees. You understand that you are solely responsible for your own decisions and actions. Accordingly, you agree to indemnify, defend and hold Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and Bob Diamond and their respective directors, instructors, officers, owners, agents, affiliates, licensors, licensees, employees, and coaches from and against any and all liability and costs, including without limitation, reasonable attorney fees, incurred by either Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies or Bob Diamond (or both) in connection with any claim arising from your personal use and implementation of the Services provided by Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and/or Bob Diamond. This includes consequential damages or any damages resulting from alleged negligence by Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies and/or Bob Diamond.

Relationship of the Parties. Notwithstanding any provision hereof, for all purposes of this Agreement and at all times contemplated hereby, each party shall be and act as an independent contractor and not as a partner, joint venturer, or agent of the other and shall not bind nor attempt to bind the other to any contract.

Assignment. This Agreement may not be transferred or assigned by any party without the prior written consent of all other parties.

Arbitration. Any dispute or claim arising from this Agreement, its performance, breach, or interpretation (including issues about its validity or enforceability), shall be exclusively (except as provided below) resolved by final binding arbitration before the American Arbitration Association (AAA), utilizing its Commercial Arbitration Rules. One arbitrator shall be selected using AAA procedures. The arbitrator shall use all reasonable efforts to minimize discovery and to complete the arbitration proceedings as expeditiously as possible. The Arbitrator shall render a written decision within thirty (30) calendar days after the hearing. The arbitrator will not award punitive, incidental, consequential, treble or other multiple or exemplary damages, such being expressly waived by all parties to the fullest extent allowed by law. However, the successful party in any such arbitration shall be entitled to reimbursement of all costs of the arbitration (excluding travel) including but not limited to attorney fees.

Unless otherwise agreed by all parties involved, any arbitration involving Diamond Law Center, LLC & RL Real Estate Development & Real Wealth Real Estate Education, Inc. & all other Bob Diamond and Ed Diamond companies or Bob Diamond shall take place in Philadelphia, Pennsylvania. All parties hereby give their irrevocable consent to the jurisdiction of the courts of or in the State of Pennsylvania, as well as processes of the AAA in Pennsylvania. Awards shall be final, binding and non-appealable (except on the minimal grounds required under the Federal Arbitration act or other applicable law). All awards may be filed with one or more courts, state, federal or foreign having jurisdiction over the party against whom such award is rendered or its property, as the basis of judgment and available collection remedies.

 Miscellaneous. The terms of this Agreement, and those incorporated by reference, may not be changed and/or modified unless made effective in writing and signed by all parties. In the event any provision of this Agreement shall be determined to be illegal or unenforceable, that provision or particular section of a provision will be eliminated or limited to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. Headings herein are for convenience and reference and shall in no way affect the interpretation of this Agreement.
